Acceptance of These Terms

By using our website, submitting a form, or opting into our text messages, you agree to these terms. If you don't agree, please don't use the site or our messaging program.

These Terms & Conditions ("Terms") govern your access to and use of the website operated by Contractors Home Appliances, Inc. ("Company," "we," "us," or "our"), including any forms submitted, communications received, and our SMS messaging program. By accessing the website, providing your information, or opting in to receive messages from us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must discontinue use of the website and decline participation in our messaging program.

Eligibility & Age Requirements

You need to be 18 or older to use our services or sign up for our texts. Our website isn't built for kids under 13, and we don't knowingly collect any information from them.

By using this service, you represent and warrant that you are at least 18 years of age. If you are under 18 years old, you may not use or access our services or opt into our messaging program.

Our website and services are not directed to children under the age of 13. In accordance with the Children's Online Privacy Protection Act ("COPPA"), we do not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected such information, we will delete it promptly.

SMS Messaging Program

If you opt in, we'll text you about your appointment, your delivery, or your inquiry — and, if you give separate permission, occasional offers. The program is here to make your experience smooth, not to flood your phone.

Contractors Home Appliances operates an SMS messaging program designed to ensure optimal customer support and respond to service-related inquiries from customers and prospective customers who affirmatively opt in. The program is operated through a standard 10-digit local number and is subject to the policies of participating wireless carriers.

Your use of, and participation in, the messaging program constitutes your acceptance of these Terms and the verbatim disclosures contained within them.

Message Types & Content

There are two kinds of texts: helpful ones about your appointment or order, and marketing ones about sales and offers. You choose which (or both) you want when you opt in.

Our messaging program may include the following categories of messages, depending on the consent boxes you check during sign-up:

  • Service updates & appointment confirmations — including delivery scheduling, installation reminders, service-call confirmations, and direct responses to inquiries you submit through our website.
  • Marketing promotions — including occasional messages about seasonal specials, manufacturer rebates, and promotional offers (only if you separately consent to marketing messages).

Each type of message requires its own affirmative consent. Consenting to one category does not enroll you in the other.

How You Opt In

In Plain English

You opt in by submitting a form — on our website, a paid ad, or another signup point we operate — and ticking a box (or two) yourself. Nothing is pre-checked. You can always submit the form without ticking the SMS boxes — texting isn't required.

To join our messaging program, you submit your details through one of our opt-in points — including forms on our website, lead forms on paid advertising platforms (such as Google, Meta, and YouTube), or other signup channels we operate — and take an affirmative action by checking one or both of the following consent options:

  • Checkbox 1 (Non-Marketing): "I consent to receive non-marketing text messages from Contractors Home Appliances about appointment reminders, delivery confirmations, and responses to my service inquiries. Message frequency may vary, message & data rates may apply. I am 18 or older. Text HELP for assistance, reply STOP to opt out."
  • Checkbox 2 (Marketing): "I consent to receive marketing text messages, about special offers, discounts, and service updates, from Contractors Home Appliances at the phone number provided. Message frequency may vary. Message & data rates may apply. I am 18 or older. Text HELP for assistance, reply STOP to opt out."

Both checkboxes are unchecked by default and the phone number field is optional. You are never required to consent to SMS in order to submit a form or do business with us.

After you submit, you will receive a one-time confirmation message reading: "You've successfully opted in to receive notifications and messages from Contractors Home Appliances. Message frequency varies; message and data rates may apply. Reply STOP at any time to opt-out or HELP for assistance."

Cancels the SMS program. You'll receive one final confirmation message.
HELP
Get assistance with the messaging program and our contact information.
Opt-Out · Required Disclosure

You can cancel the SMS service at any time. Just text "STOP" to (413) 739-8800. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed.

Help · Required Disclosure

If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance.

You may also opt out by contacting us directly at (413) 739-8800 or by emailing [email protected] and requesting removal from our SMS list.

Frequency, Rates & Delivery

How often we text depends on what's happening with your order or appointment. Your carrier's standard rates apply — we don't charge you to receive our messages.

Delivery · Required Disclosure

Carriers are not liable for delayed or undelivered messages.

Typical message volume averages between 3 and 5 messages per month, though actual frequency depends on your active service requests, appointments, and consent preferences. Contractors Home Appliances does not charge a fee to receive messages; however, charges from your wireless carrier may apply per your plan.

Privacy Policy

Your phone number and the consent you give us for texts are not sold, rented, or shared with anyone for their marketing. Full details are in our Privacy Policy.

Specifically, and as further detailed in the Privacy Policy: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Website Use

Use the site for what it's for — learning about us, contacting us, booking a visit. Don't try to break it, scrape it, or misuse the information on it.

You agree to use the website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of, the website by any third party. Prohibited activities include, without limitation: attempting to gain unauthorized access to any portion of the site, transmitting malicious code, scraping or harvesting data, and using the site to send unsolicited communications.

All content on the website — including text, graphics, logos, photographs, and the trade names "Contractors Home Appliances" and any associated marks — is the property of Contractors Home Appliances or its licensors and is protected by applicable intellectual property laws.

Disclaimers & Limitation of Liability

We do our best to keep the site accurate and the messaging program running, but we can't promise perfection or guarantee message delivery (carriers control that). To the extent the law allows, our liability is limited.

The website and messaging program are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site or program will be uninterrupted, error-free, or free from harmful components.

To the maximum extent permitted by applicable law, Contractors Home Appliances, its affiliates, and its service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the website, the messaging program, or any inability to access either. Carriers are not liable for delayed or undelivered messages.

Changes to These Terms

We may update these Terms now and then. When we do, the new version goes live here with a fresh "Last Updated" date. Continuing to use the site or messaging program after that means you accept the changes.

We reserve the right to modify or update these Terms at any time, in our sole discretion. Any changes will be posted on this page and reflected in the "Last Updated" date at the top. Material changes to the SMS program's consent practices, message types, or opt-out procedures will be communicated to active subscribers where required by law. Your continued use of the website or participation in the messaging program after such changes constitutes your acceptance of the revised Terms.
